NuVasive Intends to Appeal Court's $60m Decision

NuVasive announced on Thursday that the U.S. District Court of California issued a $60 million judgment against the company stemming from its use of the NeuroVision trademark. The ruling includes an immediate injunction against the use of the trademark, and NuVasive must comply and pay damages within 30 days. NeuroVision (the product) monitors nerve location during spine surgery.
NuVasive lost a jury trial over the trademark in October, 2010 after Neurovision Medical Products Inc., a medical device manufacturer, sued the company. This recent court order was largely expected by NuVasive, and the company expects to appeal the judgment while it does not plan on recording an accrual for the decision.
NuVasive will release their 2010 year-end results on February 23.
